Terms of Service

1. Agreement to Terms

By accessing and using the BIMI SVG Converter service ("Service") operated by Silva Node Ab ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

BIMI SVG Converter is a web-based tool that converts raster images (PNG, JPG) into BIMI-compliant SVG Tiny PS format using professional vectorization technology. The Service includes:

• Image upload and preprocessing capabilities
• Advanced image editing tools (brightness, contrast, saturation, blur)
• Professional vectorization using Potrace technology
• Multi-pass optimization to meet BIMI specifications
• BIMI compliance validation
• SVG file download

3. Pricing and Payment

3.1 Free Trial

Each user receives one (1) free conversion upon first use of the Service. The free conversion is tracked via browser localStorage and is non-transferable.

3.2 Paid Conversions

After using your free conversion, additional conversions are charged at €1.99 (EUR) per conversion. Payment is processed securely through Stripe, Inc.

3.3 Payment Processing

All payments are processed by Stripe. By making a payment, you agree to Stripe's Terms of Service. We do not store your payment card information on our servers.

4. No Refund Policy

ALL SALES ARE FINAL. WE DO NOT ISSUE REFUNDS FOR SERVICES RENDERED.

Once a conversion has been successfully completed and the SVG file has been made available for download, the service is considered rendered and no refund will be issued. This includes but is not limited to:

• Conversions where you are dissatisfied with the output quality
• Conversions where you uploaded the wrong file
• Conversions where you changed your mind after completion
• Conversions where the output does not meet your expectations
• Technical issues on your end preventing download

We recommend using your free conversion to test the Service before purchasing additional conversions.

5. User Responsibilities

5.1 Content Rights

You represent and warrant that you own or have the necessary rights, licenses, and permissions to upload and convert any images you submit to the Service. You are solely responsible for ensuring you have the right to use any trademarks, logos, or copyrighted materials.

5.2 Prohibited Uses

You agree not to use the Service to:

• Upload illegal, offensive, or infringing content
• Upload malware, viruses, or malicious code
• Attempt to circumvent rate limiting or payment systems
• Reverse engineer or copy the Service
• Resell or redistribute converted files as a competing service
• Use the Service for any unlawful purpose

6. Intellectual Property

6.1 Your Content

You retain all ownership rights to images you upload and the resulting SVG files. We do not claim any ownership over your content.

6.2 Our Service

The Service, including its design, code, algorithms, and trade secrets, is owned by Silva Node Ab and protected by copyright, trademark, and other intellectual property laws.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We reserve the right to:

• Perform scheduled maintenance
• Make updates and improvements
• Suspend the Service temporarily or permanently
• Modify features or pricing with reasonable notice

8. Data and Privacy

We process your data in accordance with our Privacy Policy. Key points:

• Uploaded images are processed in memory and not permanently stored
• Free conversion tracking uses browser localStorage (client-side only)
• Payment information is handled exclusively by Stripe
• We use Vercel Analytics for anonymous traffic analytics
• We do not sell or share your personal data with third parties

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantee of Results

While we strive for high-quality conversions, we do not guarantee that:

• Converted SVG files will meet your specific requirements
• Output will be accepted by all BIMI validators
• Conversions will be error-free or suitable for all use cases
• The Service will meet your expectations or business needs

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SILVA NODE AB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers
• Any interruption or cessation of the Service
• Any bugs, viruses, or malware transmitted through the Service
• Any errors or omissions in any content

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC CONVERSION GIVING RISE TO THE CLAIM, OR €1.99, WHICHEVER IS GREATER.

10. Rate Limiting

To ensure fair usage and prevent abuse, we implement rate limiting:

• Conversion API: 5 requests per minute per IP address
• Payment API: 10 requests per minute per IP address

Excessive usage or attempts to circumvent these limits may result in temporary or permanent suspension of access.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or resources
• Chargebacks or payment disputes

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Finland.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the modified Terms.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Silva Node Ab regarding the Service and supersede all prior agreements and understandings.
